ALMAËL — GENERAL TERMS AND CONDITIONS OF SALE AND USE

SCOPE

These terms and conditions apply to the use of the ALMAËL store and to all orders placed with ALMAËL.

By using the website or placing an order, the customer acknowledges that they have read and accepted these terms and conditions, subject to any mandatory rights provided by applicable law.

PRODUCTS

ALMAËL endeavours to present the characteristics, composition, volume, directions for use, precautions and images of its products as accurately as possible.

Slight colour variations may occur depending on the screen used. Photographs are intended to present the products and their visual universe and do not constitute a contractual guarantee that the product received will look perfectly identical.

All offers are subject to availability. If a product becomes unavailable after an order has been placed, ALMAËL will inform the customer and offer a refund or another appropriate solution.

PRICES, CURRENCIES AND TAXES

Prices are displayed in the currency available for the selected market.

ALMAËL is not currently subject to Swiss VAT. Swiss VAT must not be presented as having been collected when this is not the case.

Import taxes, customs duties or administrative charges may apply depending on the destination and the tax treatment of the order. Where this information is available, the applicable treatment will be indicated during checkout.

Shipping costs are displayed separately before the customer confirms payment.

ALMAËL may change its prices at any time. The applicable price remains the price displayed when the order is confirmed, except in the event of an obvious error.

ORDERS

Before confirming a purchase, the customer must verify the selected products, quantities, prices, delivery address and contact details.

An order becomes final once payment has been authorised and the order has been confirmed by ALMAËL, subject to product availability, an obvious pricing error, a payment issue or a reasonable suspicion of fraud.

An order confirmation will be sent to the email address provided by the customer.

PAYMENT

Payment is due at the time the order is placed.

The payment methods available are those displayed during checkout. Payments are processed through Shopify Payments or through the payment service providers displayed at the time of purchase.

ALMAËL does not directly store the customer’s complete banking or payment-card details.

REFUSAL OR CANCELLATION OF AN ORDER

ALMAËL may refuse or cancel an order in particular in the event of:

product unavailability;
an obvious error in the price or description;
payment failure;
a reasonable suspicion of fraud;
a delivery address that cannot be served;
misuse of the store.

If an order that has already been paid for is cancelled, any amounts due will be refunded to the original payment method.

DELIVERY

Orders are prepared and dispatched by our manufacturing and logistics partner. ALMAËL remains the customer’s point of contact for all questions relating to an order.

The available shipping options and applicable charges are displayed before payment. Any delivery estimates provided are indicative only and may be affected by the carrier, public holidays, the destination or customs formalities.

The customer is responsible for ensuring that the delivery address provided is accurate and complete.

RETURNS AND RIGHT OF WITHDRAWAL

The return conditions, exclusions applicable to unsealed cosmetic products, withdrawal procedure and refund arrangements are set out in the Return and Refund Policy available through the store.

ALMAËL voluntarily grants Swiss customers a 14-day return period. The mandatory rights of consumers residing in the European Union remain unaffected.

WARRANTIES AND DEFECTIVE PRODUCTS

Products benefit from all mandatory warranties provided under applicable law.

The customer must notify ALMAËL promptly if a product is damaged, defective, incorrect or otherwise non-conforming and must provide the information required to assess the request.

The recommended operational reporting period stated in the Return and Refund Policy does not remove or restrict any statutory rights relating to defects or non-conformity.

USE OF COSMETIC PRODUCTS

ALMAËL products are intended for external cosmetic use only.

The customer must follow all instructions, warnings and precautions stated on the packaging or product page. A patch test on a small area is recommended before first use, particularly for sensitive skin or scalps.

If irritation or an adverse reaction occurs, discontinue use and seek advice from a healthcare professional where necessary.

The information published on the store does not constitute a diagnosis, treatment or medical advice. Individual results cannot be guaranteed.

If you are pregnant or breastfeeding, or if you have an allergy, medical condition or are undergoing medical treatment, seek advice from a healthcare professional before using the products.

INTELLECTUAL PROPERTY

The ALMAËL brand, texts, photographs, images, graphic creations and other store content are protected by applicable intellectual property laws.

Any unauthorised reproduction, exploitation or use is prohibited.

LIABILITY

ALMAËL undertakes to fulfil its obligations with due care.

ALMAËL shall not be liable for damage resulting from improper use of a product, failure to follow the stated precautions, inaccurate information provided by the customer or an event beyond its reasonable control.

Nothing in these terms and conditions excludes or limits any liability or consumer right that cannot legally be excluded or limited.

DATA PROTECTION

Personal data is processed in accordance with the Privacy Policy available through the store.

The Privacy Policy specifies, in particular, the categories of data collected, the purposes for which they are used, the service providers involved and the rights of individuals.

FORCE MAJEURE

ALMAËL shall not be liable for any delay or failure to perform caused by an unforeseeable event or an event beyond its reasonable control, including transport disruptions, natural disasters, administrative decisions, conflicts or major technical failures.

APPLICABLE LAW AND DISPUTES

These terms and conditions are governed by Swiss law.

Subject to any mandatory rules that apply, the competent courts are located in Sion, Switzerland.

This clause does not deprive consumers residing abroad, particularly those in the European Union, of any mandatory protections or jurisdictional rights available to them in their country of residence.

Before initiating legal proceedings, the customer is invited to contact ALMAËL in order to seek an amicable resolution.
